UTTER, J.--The State of Washington appeals the trial court's dismissal of counts 1, 2, 3, and 4 of an information charging Timothy Warner with five counts of rape of a child in the first degree. The dismissal was based on a finding that the use of disclosures made during court ordered treatment of a juvenile offender to prosecute that person after he turns 18 violates due process. The Respondent, Timothy Warner, cross-appeals the trial court's finding that there was no pre-accusatorial delay justifying dismissal of the charges. The case was certified to this court by the Court of Appeals, Division II. For the reasons set forth in the opinion below, we reverse the trial court's order dismissing counts 1, 2, 3, and 4, and remand the case for further proceedings consistent with this opinion.
