AGID, J. -- Carlos Veliz appeals his conviction for first degree child molestation on the ground that the trial court erred in refusing to give the jury his proposed instruction based on State v. Powell, 62 Wash. App. 914, 816 P.2d 86 (1991), review denied, 118 Wash. 2d 1013, 824 P.2d 491 (1992). Veliz has also filed a personal restraint petition contending that he was deprived of due process, was subjected to cruel and unusual punishment, did not receive effective assistance of counsel and that prosecutorial misconduct deprived him of a fair trial. We affirm his conviction and dismiss his personal restraint petition.*fn1
